Service Description

SugaryMe is free for patients and will always be free for patients. You access SugaryMe through WhatsApp on your mobile phone. You can send health data (blood glucose readings, blood pressure, photos of test results, etc.), receive reminders about medications and appointments, and communicate with your healthcare providers. The service is provided at no cost to you as a patient.

Registration

To use SugaryMe, your doctor or hospital staff will link your phone number to the service. You do not need to download an app or create a separate account. Once linked, you can start using the service by messaging the SugaryMe WhatsApp number. You are responsible for ensuring that the phone number you use is yours and that you have access to it. You agree to notify your doctor or us immediately if you change your phone number or if you suspect unauthorized access to your WhatsApp account.

Using the Service

When using SugaryMe via WhatsApp, you agree to:

• Provide accurate and truthful health information
• Use the service only for legitimate healthcare purposes
• Not use the service to send spam, abusive, or inappropriate messages
• Comply with WhatsApp's Terms of Service and Community Guidelines
• Understand that SugaryMe is a tool to support your healthcare but does not replace professional medical advice or emergency care

WhatsApp Business API Terms

SugaryMe uses WhatsApp Business API, which is provided by Meta (Facebook). By using SugaryMe through WhatsApp, you acknowledge that:

• Your use of WhatsApp is subject to Meta's Terms of Service and Privacy Policy
• Message delivery depends on WhatsApp's service availability and your internet connection
• We cannot guarantee that messages will be delivered instantly or that you will receive all messages
• WhatsApp service may be interrupted, delayed, or unavailable due to technical issues, maintenance, or factors beyond our control
• You need an active WhatsApp account and internet connection to use the service

For Doctors and Hospitals Using the Dashboard

Dashboard Access and License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the SugaryMe dashboard for healthcare purposes only. You may not copy, modify, distribute, sell, or lease any part of the dashboard or its content, nor may you reverse engineer or attempt to extract the source code, unless you have our written permission.

Registration and Account

To use the dashboard, you must register and create an account with your professional email address and credentials. You are responsible for providing accurate and complete information when registering and for keeping your account secure. You agree not to share your account credentials with anyone else and to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage caused by your failure to protect your account.

Patient Data Access and Responsibilities

As a healthcare provider using the dashboard, you agree to:

• Access patient information only for legitimate healthcare purposes and in accordance with your professional duties
• Maintain patient confidentiality and comply with all applicable healthcare privacy laws and regulations, including POPIA
• Only link patients to the service with their consent or as authorized by your hospital or clinic
• Ensure that patient information is accurate and up-to-date
• Not share your dashboard access with unauthorized persons
• Report any security breaches or unauthorized access immediately

Fees and Billing for Healthcare Providers

SugaryMe is free for patients and will always remain free for patients. For healthcare providers (hospitals and clinics), we offer a free pilot phase. After the pilot, the paid version launches and subscription or usage fees apply. Fees are invoiced and sent by email only; we do not use debit orders or any other automatic payment methods. Payment is made against the emailed invoice. Billing arrangements are made directly between SugaryMe and the hospital or clinic administration. Content and Data

For Patients: You own all the content and data that you send via WhatsApp to SugaryMe, such as your blood glucose readings, health measurements, photos of test results, and messages. You grant us a non-exclusive, royalty-free, worldwide license to use, store, back up, and display your content and data for the purposes of providing healthcare services, sharing information with your authorized doctors, and improving the SugaryMe service. You also grant us the right to aggregate and anonymize your content and data (removing all identifying information) for research and analysis purposes to improve diabetes care.

For Doctors: You own any notes, observations, or clinical data that you enter into the dashboard. You grant us a license to store and display this information as part of the patient's medical record. Patient data that you access through the dashboard remains subject to the patient's ownership and privacy rights.

You are solely responsible for the accuracy, quality, and legality of your content and data. You agree not to send or enter any content or data that is unlawful, harmful, abusive, defamatory, obscene, invasive of privacy, or infringes on any intellectual property rights of others. We reserve the right to remove any content or data that violates these terms or our policies at our sole discretion.

We respect your privacy and are committed to protecting your personal information. SugaryMe is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, secure, or accurate. We do not warrant that the service will meet your requirements or expectations or that it will diagnose, treat, cure, or prevent any disease or condition.

Important Medical Disclaimer: SugaryMe is a tool to support healthcare management and communication. It is NOT intended to replace professional medical advice, diagnosis, or treatment. It does NOT replace emergency medical care. You should always consult your doctor before making any health-related decisions. If you have a medical emergency, call emergency services immediately. Do not rely on SugaryMe for emergency medical situations.

WhatsApp Service Limitations: SugaryMe depends on WhatsApp's service availability. We cannot guarantee that messages will be delivered instantly, that you will receive all messages, or that the WhatsApp service will always be available. Message delivery depends on your internet connection, WhatsApp's service status, and factors beyond our control. We are not responsible for delays, failures, or interruptions in WhatsApp service.

We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or in connection with your use of or inability to use SugaryMe, its content, or services. This limitation applies to the fullest extent permitted by South African law.

Changes to These Terms

We may change these terms and conditions at any time by posting an updated version on our website or notifying you by WhatsApp (for patients) or email (for doctors). Your continued use of SugaryMe after such changes constitutes your acceptance of the new terms and conditions. If you do not agree to the changes, please stop using the service and contact your doctor to be unlinked from the service (for patients) or contact us to close your account (for doctors).

Termination

We reserve the right to suspend or terminate your access to SugaryMe at any time, with or without notice, if you violate these terms and conditions, engage in fraudulent or illegal activity, or for any other reason we deem necessary to protect the service or other users.

You may stop using SugaryMe at any time. Patients can request to be unlinked from the service by contacting their doctor or us. Doctors can close their dashboard account by contacting us at info@sugaryme.com. Upon termination, we will retain your data in accordance with our privacy policy and legal obligations.
